AN INSUBORDINATE VOLUN TEER.
A charge of insubordination (says the Kapunda Herald of Out. 10) was preferred on Wednesday by Major Oldham (in compliance with instructions from head-quarters) against Private Lovering, for disobedience of orders in September in refusing to carry a box of ammunition from the ground. The defence set up was that the squad had been dismissed before the order was given by Lieutenant Bosnian in the first instance, brt this was denied and a conviction resulted. The Court expressed the opinion that the charge should have been laid under the 75th clause in place of 79th, the latter fixing the penalty at £lO and the former at £5, but the Major said he was instructed today under the latter clause. A fine of £lO and £1 costs had therefore to be imposed* but the Court allowed three weeks for payment in order to give defendant time to memorialize for a reduction of the fine. This volunteer was a victim to obstinacy, as Major Cldhara mentioned that if he had carried the box when ordered by him, the first refusal would have been overlooked. As however, Lovering had said he would not carry it, he resolved to keep his word, and hence the proceedings.
