KUMARA EDUCATION RESERVE
The following fc si copy of the Bilf introduced by the Hon. W. Gisbome for the purpose of dealing with, the"" Kumara Education Reserve : 1. The short title of.this Act ia "The Kumara Education Reserve Act,1879," and it shall cotne into operation ou such day as the Governor in Council shall' appoint. 2. From and after the date aforesaid all laws relating "to. gold fields and to Wardens' Courts shall operate within the lands described in the Schedule horpto, generally known as the Kumara Education Reserve, as if the same had'' never, been reserved' or granted ■ and' every holder of a miner's right or business license may exercise the same' respectively over the aforesaid lands, subject to the provisions' of this Act,' and of "The Mines Act, 1877," and of any regulations to be made under either such Acts. M 3. Saving and excepting as hereinbefore specially provided, nothing in this Act contained s hull in any way affect the title of the School Commissioners of the Westbmd Education District to the aforesaid reserve, or shall authoi--' ize + he sale of any portion of such re* serve.
, , 4. Nothing in this Act contained shall affect any leases, contracts, licenses, or agreements lawfully made and Existing at the time of the coming intr operation of this Act. 5. The School Commissioners aforesaid, and some pe-s'oh to he appointed in that behalf by the Minister of Lands, shall appoint a scale of fees to he charged in lespect of the occupation for mining purposes of any portion of the Said lands, and all moneys arising from such occupation shall be Jniid to the School Commissioners aforesaid. If no such scale of fee* he made to the Satisfaction of the Minister aforesaid within a time to he, limited, by hirfi in that.respe'ct, the sakl Minister may ap : point smie other perso'n foithwitli to fees,, G. It shall he lawful for the Governor in Council, und i- regulations to be made in that behalf, notwithstanding anything contained in any Act relating to iiiining, from time to time to grant to any occupant of land under business license in the Knmara Mining.. District; who has improved such laud to the satisfaction of • the Warden of the district, a lease for any term hot exceeding twenty-one years of the surface of such lainii at such lates of payment for rent, and nnder such restrictions as to' the use thereof, as he may think necessary, and such lease shall entitle the holder thereof to sill the rights and privileges row enjoyed by holders-of business licenses issued under any'Act relating to mining. , 7. If at any time during the cur r'ency or at the fermihation of any lease heretofore granted or hereafter to oe granted the land leased is proved to the satisfaction of the Governor in Council to be not auriferous, the land may, with the approval of the' Governor, be sold by public auction subject to Valuation for improvements, as provided for in sections forty-three and forty-seven of "The Mines' Act, 1877." ,-Provided always that no part of the aforsaid land which is comprised within the limits.described in the Schedule hereto shall be sold, except with the Consent of the School Commissioners h'ereifi above named ; and also, that all proceeds of any such last mentioned iale shall be paid to the said Commissioners, and be applied by them in the purchase of other lands to be held by them for the same purposes as the land which is sold was held. & The Governor, with the concurrence of the aforesaid School Commissidneis, may at any time exchange the lands described in the Schedule hereto, or any part thereof, for other Crown lands of equal valne or extent not being aurifeiouK, within the Land District of Westland, and may grtfnt the same in manner and for the same purposes as the land in the said Schedule is now held. ..' ... SCHEDULE. All thttt area in the Provincial District of Westland, being Reserve No. 1.28, containing 1000 acres, more or less, situate in the Arahura district ; bounded on the westward by the Greenstone road, on the northward by reserve No. 08, 'on the d southward by section 1852, and on the T eastward by a line 40 chains distant from and parallel with Greenstone roa-d.
