MINING REGULATIONS UNDER “THE MINES ACT, 1877.”
Any person discovering new gold j ■ working, and being desirous of obtain- j ' ing an increased area thereon shall I mark off a prospecting claim, as pro- | vided in Regulation 11, and shall im- ' ( mediately report such discovery with : full particulars to the Warden, and the '• ground so marked off shall be protected until the Warden shall have finally re- : fused or granted the claim ; but the j Warden may, if he think fit, refrain j from granting or refusing such claim | [ until the ground shall have been visited by ; himself or by anyone appointed by him. i Notices of all prospecting claims ! granted, with full particulars of locality, ; yield of gold, and description of work- j mgs, shall be posted by the Warden on ' the outside of his office for public infor-' mation. It shall not be lawful for the Warden ■ to grant a prospecting claim for any new discovery at a less distance than I two miles from any previously existing ; .workings in alluvial ground, nor to I | giant a prospecting claim for any new : discovery of a quartz leef at a less dis. ! tance than half a mile from any | ; previously existing quartz workings. j | Every prospecting claim shall, after ; | being marked, be held by one man re-; ' maining on the ground during working ! I hours until the application is dealt with, ! | and, if granted, the claim must, unless I 1 by special permission of the Warden, i | be fully occupied within seven days j | from the date of grant. 1 i The Warden may, if he think fit, ! | grant a prospecting claim to the actual 1 ! discoverer of new gold workings con- 1 ; jointly with persons who ; have assisted ; ; them in prospecting either with conti i-1 ; bntions or otherwise, or with other per- j ■ sons who may be nominated by the | j actual disco v eiers, although the said i j persons may not have been on the 1 j ground prior to the granting thereof. 1 I The Warden may, upon the applica- i I tion of any persons forming a party of j i not less than four, grant protection for j not more than three mouths for a I prospecting area “ at a distance of not' 1 less than two miles from any existing j workings in alluvial ground, or in the i I case of quartz workings of not less than I half a mile from any existing quartz | workings : Provided in no case shall ! ! any such prospecting area be granted : within half a mile of any other such ' i prospecting area. Provided further i : that such protection shall only continue i in force until gold is struck, in which ease the discovery shall be reported,' or until the holders tire required by the \ . Warden to mark a prospecting claim, 1 , in either of which cases a prospecting 1 claim shall be marked and applied for as provided in Regulation 11. and V., and protection shall therupon cease, as to ' the remainder ot such prospecting area. ■; It shall be lawful for the Warden to renew from time to time the protection for a prospecting area. Provided that such rmewed protection shall not be I granted for more than three months at any time. I Every prospecting area shall be continuously worked by at least two men during the entire period of occupancy.
