A REFUTATION.

: [to the editor,] ■ Sir—-Last night ray attention was called -, : to a letter of B J, Seddon in your paper j of the 7th inst,, wherein he refers to me j as plaintiff in a case heard at Golds- | borough. Assome of his statements are ; entirely untrue and likely to mislead, and j I think so intended, I feel it my duty to expose them, j We claimed damage done by water from . j the Wainiea water-race, but never said J tiiat defendant had opened overflow of ' : race. We could not and ’did not fix I blame on anyone in particular, but.’ wera.,- ; I led to believe that we . had a claimagainst f , the Government for damage done. That ' j portion of the race was under contract at I the time, j It is also untrue that it “took four men to remove stones that were swept iqtd our ; ■ tail-race,” We removed all .the stones • | without any assistance whatever, no other i person being present at the time. ' ; It is also untrue rna. we held' the ‘ ! ground “ previous to the race being , 1 made.'’ Wo no\\ imnade any such'state*-1 incut to Mr fcljcidou or to any other map,..', . o wore hot.'n employed on the .race, 1 ing its construction, myself on wages for many mouths, and O' Grady as a sub- ;

Sdfih'actor on some deep cutting. It was after we had finished our work on the tace that we worked together in the ground referred to by Mr Seddon. Until Mr Gow served us with a notice (a short time previous to the damage done) to discontinue working that ground, we thought our Workings wore outside the reserve. Subsequently Mr Seddon’s measurements, however, led us to believe our boxes and part of our workings were outside of the reserve; hence the case coming before the Court, as stated. Nelson. Stoney Creek, Pox’s, 10th. December, 1878.
