THE HOCHSTETTER WATERRACE.
[press agency.]
Reefton, March 13
Mr Warden Shaw yesterday delivered an important judgment in the case of Sheehan and others v. a number of sluicing parties at Nelson Creek. The complainants hold a registered right to a head-water-race at Nelson Creek, about two miles below the termination of the Hochstetter race. They applied for an injunction to restrain"all parties against sluicing with water from the Hochstetter race, as the tail water and debris therefrom plugged their (Complainants') head water aud choked their race. The Warden held that the complainants' registered rights must be respected, and accordingly ordered the injunction to issue. The effect of this decision is to put a stop to all sluicing from the Hochstetter race as the Nelson Creek is the only channel for the outflow of the Government race-
water, and Sheehan and party draw their supply from that source. ;
