RESIDENT MAGISTRATE'S COURT.
Thursday September 20th, 1877. (Before M. Price, Esq., R.M.) POLICE CASES. Patrick O'Brien and Robert Young, for being drunk and incapable, were fined 10s each, with the usual alternative. CIVIL CASES. King v. Driscoll.—Claim, account stated £ls 19s Mr Perkins for defendant, and his wife, and for cash and refreshment (whisky.) His Worship at once disallowed the amount for whisky. Complainant, his wife, and Mr Poole were examined for the complainant, and for the defendant, himself, his wife, and Mr Thompson. Defendant admitted £4 Is 6d of the claim. His Worship gave a verdict for £4 Is 6d, with costs of Court. Driscoll v. King.—Claim, wages £5. This was a claim for balance of wages, and for part of a week of which the service was not completed, also for a week's salary in lieu of notice. Mr Perkins withdrew the last item of the claim. His Worship gave a verdict for plaintiff for £3 15s, with costs and professional fee. Dungan and O'Brien v. Taylor.—Mr Perkins for plaintiff. Mr Hawkins, for defendant, applied for an adjournment, in order to obtain particulars of claim. Adjournment till next week. Blake v. Callanan.—This was an action of ejectment and a claim for .£lO for damages. Mr Perkins appeared for plaintiff, Mr Hawkins for defendant. The defence was that the notice to quit had been made for the adjoining section, which was not occupied by defendant. Plaintiff accepted a nonsuit with costs. Olsen v. Hoist.—Claim, goods £22 17s 4d. Defendant did not appear. Verdict for plaintiff with costs. McLean v. Macaulay—Claim, goods £3 lis 6d. Mr Perkins for plaintiff. Defendant admitted the debt, but asked for time until a tunnel he was working in should reach the claim. Verdict for plaintiff.
