DEFENDANT FINED FOR ASSAULT.
The Magistrate's Court at Te Kuiti was occupied practically the whole of Wednesday hearing the case of Kirkwood v.Clapham, in which the plaintiff claimed £32 10s for wages and commission and also charged defendant with assault. Mr Sharpies appeared for plaintiff and Mr Hine for defendant. The amount .l'ir> 10s and 15s costs had been paid into court by defendant.
The issue of the civil ease hung upon the question as to whether the parties had agreed that plaintiff should work on wages and commission or upon wages only. A document had been 3igned by both, but it had been lost. After hearing lengthy evidence from the parties and from Mr G. P. Finlay concerning the terms of the agreement, his Worship non-suited plaintiff in the civil action with costs. On the charge of assault defendant was fined £2 and costs.
