SPREAD OF A FIRE.
£2OO Damages Given. [llY TKLKUHAI'H. I'HKKS ASSOCIATION.] Auckland, This Day. A case of interest to farmers was heard before Mr Cutten, at the Magistrate's Court yesterday. J. M. and B. Metcalf and John' Bab are owners of adjoining; land at Paharoa. The action was for damages, which the former alleged they sustained as the result of a lire which Bab lit upon his land spreading on to plaintiff's land and burning the grass, bush and fences, Bab did not deny that he lit the fire on his land, but denied that it spread to plaintiffs' and brought evidence with the object of showing there was a (ire on plaintiffs' land at. the time he lighted his fire. He contended that* even if his fire did spread to plaintiffs' land, he was not responsible for the whole damage. The Magistrate held that the fire spread from defendant's to plaintiffs' land and awarded amount i claimed—£2oo.
