ONGARUE COACH ACCIDENT.
Prosecution Fails
Herbert Peak, driver of Mr Moore's J coach from Ongarue to Mangaroa was accused last court day at Taumarunui of trotting across the railway track on the occasion of his coach being run into by a goods train on March 24th last. Constable Owen, of Ongarue, prosecuted and Mr Finlay appeared for Peak. The engine-driver, Robert Pittavvay, swore he blew the whistle before he reached the crossing, and his evidence was confirmed by Kerr, the stoker. The guard, Wood, was not positive that he heard the whistle, but might have heard it without taking any notice of it, as he was busy writing at the time. Mr Finlay, for the defence, argued that the charge should be dismissed, because Peak had stopped as required and hearing no train and no whistle had got on to the line, but the train coming on him he had no time to turn back, and so did the only thing possible, namely, whipped up his horses. Peak's evidence confirmed this statement, and though Constable Owen cross-examined at some length, the I Bench decided to dismiss the case.
