This B.v-law may oe cited, or referred to as " The Sanitary By-law, 1908," and shall come into force on the thirty-first day of March, 1908 ; .nd shall apoly to that portion of the Waitomo County as is bounded, towards the west by the western boundary of the Railway line from its point of intersection with the right bank of the Mangaokewa stream, in a southerly direction to its point of intersection with the northern boundary of the Te Kuiti Native Township, thence towards the west and south along the western boundary of the Te Kuiti Native Township to the southern point of John Street, thence by a right line south east to the southern boundary of the AwakinoMokau road, thence by a rightline to the eastern corner of that piece of land called or known as i e Kuiti 28, Number I Block, thence along the eastern and northern boundaries of Te Kuiti, Number 28, Number I Block, to the north-eastern boundary of Section I, Block 15, Orahiri Survey District, thence along the said northeastern boundary of Section I, Block 15, Orahiri Survey District, to the Mangaorino road, thence along Mangaorino road to the north-west corner of Lot I, Te Kuiti Village Settlement, thence west by a right line to the right bank of the Mangaokewastream, thence along the right bank of the Mangaokewa stream to the point of commencement. 2. For the purposes of this By-law Jhe said portion of the Waitomo County shall hereinafter (except where the context requires a different construction) be referred to as the Te Kuiti Town District. 3. In this By-law, except where inconsistent with the context: — " Approved " shall mean approv- • ed by the County Engineer. " County " means the County of Waitomo. " County Engineer " means the Engineer for the time being, appointed by the Council ; and if no person be so appointed then the County Clerk of the County shall be deemed to be the County Engineer for the purposes of this By-law. " Council " means the Waitomo County Council. " Drain " includes every passage, pipe or channel, on or under ground for the conveyance of rainfall or surface water. " Public Drain " means any drain under the control of or maintained by the Council. " Private Drain " means any drain other than a public drain. " Factory " means a factory as defined in " The Factories Act, 1901." " House " includes hotel, boardinghouse, office, school, public hall, and any building occupied, or intended to be occupied, by human beings. " Household Refuse " includes ashes, cinders, dust and all ether household rubbish and refuse, but does not include trade refuse. " Inspector of Nuisances " means the inspector of nuisances for the time being, appointed by the Council; and if no person be so appointed, then the County Clerk shall be deemed to be the Inspector of Nuisances for the purposes of this By-law. '' Licensed Sanitary Drainer " means a person licensed to construct sewers under the provisions of this By-law. " Occupier " (in respect of any premises) means the person by whom or on whose behalf, such premises are actually occupied ; and in the case of a factory includes any agent, manager, foreman or other person acting or apparently acting in the general management or control of such factory ; and in the ease of any premises not in the actual occupation of any person means the owner. " Owner ' ; of any land, messuage, tenement, house or building means the person for the time being entitled to receive the rack rent thereof, or who would be so entitled if the same were let to a tenant at a rack rent. " Offensive Matter " includes offal, putrid or decayed animal or vegetable matter or fish, the refuse of fruit and vegetables, carrion, dead animals, and any other matter giving off an offensive odour or that is in any way injurious to health, " Place of Worship " includes church, chapel, and any building used wholly or chiefly for public worship or religious instruction and not permanently inhabited by any human being. " Privy " includes earth closet, water' closet, pan privy, and every place for -the reception of fecal matter. " Sufficient privy " means a water closet or pan privy of the description, with the fittings and connections, and placed as required by this By-law. " Sanitary Convenience" includes privy, urinal, sink, bath, lavatory, ashpif, sewage tank, and any receptacle, appliance or thing for the reception or removal of human or animal excreta, sewage, urine, or dirty water or other liquid waste. " Sewage tank " means a tank or fixed receptacle for the reception and disintegration of sewage con- -.'-. structed and placed as in this ByLaw provided.
