T AND TRANSFER ACT LANDS ALIENATED or contracted to be alienated from the Crown in fee prior to the coming into ooerntion of "The Land Transfer Act, 1870," may be brought under the provisions of tho Act by application irom the porsons entitled thereto. All Lands olionated from the Crown after the coming into operation of "The Land Transfer Act, 1870," are subject to, and must be dealt with, in manner prescribed by the Act. The following are examples f the fee payable lor bringing tho land under tho pro visions of the Land Transfer Act:— 1. Whon the Title consists of a Grant, dated on or subsequent to tho 28th December, 1841, none of the land included in which has been dealt with — Where tho Certificate of title is directed to issue in tne name of tho A iplicant : Value of land £100 PO 11 2 Where the Certificate of title is directed to issue in the name of the Purchaser: Value of land £100 1 10 0 These charges are increased by 4s 2d (Assurance Fund) for every additional ■ £100 in value. 2. When the Applicant is tho original Grantee, and tho land has been dealt with ; or where the Applicant is not tho original Grantee— Where the value of the land is £100 £2 14 2 Where the value of the land £200 3 8 4, Where the value of tho land is £300 3 12 6 Whero the value of the land is £400 ... 4 18 Where the value of land is above £400, the fees increase at the rate of 4s 2d (Assurance Fund) for every additional £100 in value. These charges also represent the cost of Conveying Land. Infasmuch as applicants to bring land under the Act can direct the Certificates of Title to issue in the names of any other persons. Credit for Fees is Given, When desired by the Ap]. licant in all cases where the proprietor applies, to have tho land! registered under the Act in his own name t and the fees may remain unpaid until laad is dealt with. Any person, therefore, who wishes to g his land under the provisions of tho Act, order that whenever he deals with it he be in a position to avail himself of ] facilities afforded by having a Registered Title, can do so Without Any Present Cost, . by allowing the fees to remain unpaid until such dealing, takes place. Be will then bo in a position to Mortgage, Transfer, Lease, or otherwise deal with his land at a moment's notice. i Any Title, however long and complex, may be investigated at a cost to the Applicant of only Five Shillings j for if the Title is reected all fees are returned, with tho exceptior of that amount. CERTIFICATES OP TITLU ARE ABSOLUTELY INDEFEASIBLE. ALL TITLES ARE GUARANTEED Bl THE GOVERNMENT. On all Conveyances by Deed under the old system, the cost of registration in the Deeds Registry, over and above the Solicitor's charge, is never less than Fifteen Shillings, frequently very much more ; while land which has been bought under tho provisions of " The Land Transfer Act " can be transferred at a total cost of Eleven Shillings where a whole section is conveyed ; and where only part is conveyed (and therefore a fresh Certificate of Title is Necessitated), of Thirity -one 'Shillings, which is the highest sum allowed by the Act, no matter what the yalue or area of the land. Under the Regulations in force on and after tho Ist January, 187fc> the charge for Certificates of Titles issued upon Memoranda of Transfer is reduced to Ten Shillings in all cases where the value of the land is under Ten Pounds. Tho total cost of executing a mortgage or lease of land, registered under the Act, is Twelve Shillings, no matter what the amount involved. A mortgage may be transferred or dischargod, or a lease transferred or surrendered for Jivo Shillings. . THESE OPERATIONS INVOLVE NO DELAY. Tho following are some of tho ad -nnttges {onferred by tho Land Transfer syst&ai tI. 1 It secures tho principal benefits and ad- ; vantages sought to be attained in a system of registration of deeds. 2.JIt renders retrospective investigation of title unnecessary as to. all land re. gisterod. 8., It simplifies the Titles to Real Pioporty for the future, 4. It makes purchasers of the fee and leases perfectly secure. 6. It simplifies, to the utmost possible extent, the iorn.s of transfer and th< modes of conveyance. 6»- It increases the ealeuble value of land.. 7. It tends to lower tho rate oi'intorest oi loans secured on hinds'. 8. It gives facilities ior- the sale of larg •' : cstutes in allotments. 9i Transactions can be eflectcd at moment's notice, and at a minimur of cost. 10.
