T AND TRANSFER ACT LANDS ALIEN AT ED or contracted to bo alienated from the Crown in fee prior to the coming into on.oration of " The Land Transfer Act, 1870," may be brought under (he provisions of the Act by application from the persons entitled thereto. All Lands alienated from the Crown after the coming into operation of " The Land Transfer Act. 1870," ar6 subject to, and must be dealt with, in manner prescribed by the Act. The following aro examples f the fee payable for bringing the land under the pro visions of the Land Transfer Act: — I.- When the Title consists of a Grant, dated on or subsequent to the 28th December, 1841, none of the land included in which has been dealt with— Where the Certificate of title is directed to issue in the name of the A iplicant : Value of land £100 ,-PO 11 2 Where the Certificate of title is directed to issue in the name of the Purchaser: Value of land . % , £100 1 10 O-' These charges are increased by 4s 2d (Assurance Fund) for every additional £100 in value. 2. When the Applicant is the original Grantee, and the land has been 1 dealt with ; or where the Applicant is not tho original Grantee — Where the Tiiiue of the land is £100 £2' 14 2 Where the value o! the land £200 3 3 4 Where the value of the land is £300 ... ' 3 12 6 Where the value of the land is ! £4.00 /4 1 8 Where the value of land is above £400, the fees increase at tho rate of 4s 2d (Assurance Fund) for every additional £100 in value. Thea<? charges also represent tho cost of Conveying Land. Inasmuch as applicants to bring Jand under the Act can direct the Certificates of Titio to issue in the names of any other persons. Credit for Fees is Given, When desired by the Applicant in all cases where the proprietor applies to have the land registered under the Act in his own name, and the fees may remain unpaid until la ad is dealt with. Any person, therefore, who wishes to. {. his land under the provisions of tho Act, order that whenever he deals with it be be in a position to avail himaelf of facilities afforded by having a Registered Title, can do co Without Any Present Cost, by allowing tho fees, to remain unpaid until such dealing takes place. He will then be in p| position to Mortgage, Transfer, Lease, or otherwise deal with his land at a inojn.ent'3 notice. Any Title, however long and complex, may bo investigated at a cost to the Applicant of only Five Shillings ; for if tho Title is re* ected all fees are returned, with the exceptior of that amount. CERTIFICATES OF TITLE ARE ABSOLUTELY INDEFEASIBLE. ALL TITLES ARE GUARANTEED JBI THE GOVERNMENT. On all Conveyances by Deed under the old system, the cost of registration in the Deeds Registry, over and a.bpve tho Solicitor's charge, is never less than Fifteen Shillings, frequently very much more ; while l,and%hich has been bought under the provisions oi '-'The Land Transfer Act " can be transferred at a total coat of Eleven Shillings where a whole section is conveyed j and where only partis conveyed (and therefore & fresh Certificate of Title is necessitated), of Thirity-one Shillings, which i 8 the highest sum allowed by the Act, no matter what the yalue or arep, of the la.ndf Under the Regulations in force on and after the Ist January, 187fc, the r cfiarge for Certificates of Titles issued upon Memoranda of Transfer is reduced to Ten Shillings in all cases where the value of the laud is undor Ten Pounds. The total cost of executing a mortgage or lease of land, registered under the Act, is Twelve Shillings, no matter what the ampunt involved. A mortgage may be transferred or discharged, or a lease transferred or surrendered lor live bhillinge. THESE OPERATIONS INVOLVE NO DELAY. The following are some of the ad'antiges inferred by the Land Transfer syste ui :~ 1. It secures the principal benefits and ad- . It simplifies, to tho utmost possible extent, the lorn.s of transfer and the Uiodes of conveyance. 6. It increases th? saleable value of land. 7- It touds to lower the ra t o 9 i Merest on loans secured on lunds. 8. It gives facilities lor the sale of We estates in uilotments. 9.
