TAND TBANSFEBACT LANDS ALIENATED or contracted to be alienated from the Crown in fee prior to the coming into operation of "The Land Transfer Act, 1870," may bo brought under the provisions of the Act by application from tbe persons entitled thereto. All Lands alienated from the Crown after the coming into operation of "The Land Transfer Act, 1870," are subject to, and must be dealt with, in manner prescribed by the Act. The following are examples f the fee,, payable for bringing the land under the pro" visions of the Land Transfer Act : — 1. When the Title consists of a Grant, dated on or subsequent to the 28th December, 1841, none of the land included in which has been dealt with— Where . the Certificate of title is directed to issue in tne name of the A iplicant : Value of land £100 ... ... ... ... m 11 2 Where the Certificate of title is directed to issue in the name of the Purchaser : Value of land £100 ... ... ... 1 10 0 These charges are increased by 4s 2d (Assurance Fund) for every additional' £100 in ralue. 2. When the Applicant is the original Grantee, and the land has been dealt with j or whero the Applicant is not the original Grantee— Where the ralue of tbe land Is £100 ... Credit for Fees is Giren, Whon desired by the Applicant in all cases where the proprietor applies to have tl\e land registered under the Aot in his own name, : and tho fees may remain unpaid until '< laod is dealt with,. Any person, therefore, who wishes to. { his land under the provisions of the Act, order that whenever ho deals with it ho be in a position to avail himself of facilities afforded by having a. Registered : Title, can do so Without Any Present Cost, by allowing tho fees to remain unpaid until \ such dealing talfes place. He will then be in a position to Mortgage, Transfer, Lpase,, , or otherwise deal with his land at a moment's notice. Any Title, however long and complex, may '• be investigated at a cost to the Applicant of only Five Shillings ; for if the Title is re- : ected all fees are returned, with the exceptior 1 of that amount. OERTf^CATES. GE TITLE ARE ABSOLUTELY INDEFEASIBLE, i ALL TITLES ABE GUARANTEED Bl THE GOVERNMENT. On all Conveyance? by Deed under the old system, the cost of registration ip the Deeds Registry, over and above the Solicitor's charge, ' is never less than Fifteen Shillings, frequently I very much more ; while land which has been ' bought under the provisions of ° The Land Transfer Act" can be transferred at a total cost of Eleven Shillings inhere a whole section i is conveyed ; and where only part is conveyed (and therefore a fresh Certificate of Title is necessitated), of Thirity-one Shillings, which is the highest sum allpwcd by tbe Act, no matter what the yalue or area of the land. Under the Regulations in force on and after i the Ist January, 187fc> the charge for Certifi- ! cates of Tith* issued upon Memoranda of Transfer is reduced to Ten Shillings in all : cases whero the value of the land is under Ten Pounds. I The total' cost of executing a mortgage or lease of land, registered under the Act, is > Twelre Shillings, no matter what the amount involved. A mortgage may be transferred or discharged, or a lease transferred or surrendered for Fire Shillings. THESE OPERATIONS INVOLVE NO DELAY. The following are some of the ad"anttges inferred by tbe Land Transfer system .«— 1. It secures the principal benefits and advantages sought tp be attained in a system of registration of deeds. 2.;_lt renders retrospective investigation of 1 title unnecessary as to all land registered. 3, It simplifies th ?
