TT AND TRANSFER ACT LANDS ALIENATED or contracted to bo alienated from the Crown in fee prior to tho coming into operation of "The Land Transfer Act, 1870," may bo brought under the provisions of tho Act by application from the persons entitled thereto. All Lands alienated from the Crown after tho coming into operation of '• Tho Land Transfer Act. 1870," are subject to, and must bo dealt with, in manner prescribed by the Act. Tho following are examples f tho fee payable for bringing the land under the pro visions of the Land Transfer Act: — 1, When the Titlo consists of a Grant, dated on or subsequent to the 28tb December, 1841, none of the land included in which has been dealt with— Where the Certificate of titlo is directed to issue in tne name of the A >plicant : Value of land £100 ... iPO 11 2 Where the Certificate of title is directed to issue in the name of the Purchasers Valuo of land £100 1 10 0 Theso chargc9 aro increased by 4s 2d (Assurance Fund) for every additional £100 in value. 2. When the Applicant is the original Grantee, and tho land has been dealt with j or where the Applicant is not tho original Grantee — Whoro the value of the land is £100 £2 14 2 Where the valuo of tho land £200 3 3 4 Where the value of the land is £300 3 12 6 Whore the value of the .land is £400 4 1 8 Where tho value of land is above £400, the fees increase at the rate of 4s 2d (Assurance Fund) for every additional £100 in value. These charges also represent the cost of Conveying Land. Inasnracfi as applicants to bring land under the Act can direct tho Certificates of Title to issue in the names of any other persons. Credit for Fees is Givon, Whon desired by tho Applicant in all cases whoro tho proprietor applies to hare the lan<? registered under the Act in his own name ; and tho fees may remain unpaid until laad is dealt with. Any person, therefore, who wishes to f his land under the provisions pf tho Act, order that whenever ho deals with it he be in a position to avail himself of facilities afl'orded by having a Regiaterec% Title, can do so Without Any Present Cost, by allowing tho fees to remain unpaid until such dealing taises place. He will then be in a position to Mortgage, Transfer, Lease, or otherwise deal with his land at a moment's notice. Any Title, however long and complex, may I be investigated at a cost to the Applicant of only Five Shillings ; for if the Titlo is reected all fees are returned, with the exception of that amount. CERTIFICATES OF TITLE ARE ABSOLUTELY INDEFEASIBLE. ALL TITLES ARE GUARANTEED BY THE GOVERNMENT. On all Conveyances by Deed under the old system, the cost of registration in the Deeds Registry, over and abore the Solicitor's charge, ia never Uaa than Fifteen Shillings, frequently very much more j while land which has been bought under the provisions of " The Land Transfer Act " can be transferred at a total cost of Eleven Shillings where a whole section ia conveyed ; and where only part is conveyed (and therefore a fresh Certificate of Title is necessitated), of Thirity-one Shillings, which ia tho highest sum allowed by the Act, no matter what the value or area of the land. Under the Regulations in force on and after the Ist January, 187&, the charge for Certificates of Titles issued upon Memoranda of Transfer is reduced to Ten Shillings in all cases where tho value of the land is under Ten Pounds. The total cost of executing a mortgage or lease of land, registered under the Act, is Twelve Shillings, no mattor what the amount involved. A mortgage may bo transferred or discharged, or a lease transferred or surrendered for Five Shillings. THESE OPERATIONS INVOLVE NO DELAY. The following arc some of tho ad mntiges inferred by the Land Transfer systcn ;— 1. It secures the principal benefits and advantages sought to bo attained in a system of registration of deeds. 2. % 1t renders retrospective investigation of title unnecessary as to all laud ro* gistcrcd, 3. It simplifies tho Titles to Real Property for tho future, 4. It mates purchasers of the fee and leases perfectly secure. 5. It simplifies, to the utmost possible extent, tho forms of transfer and the modes of conveyance. G. It increases tho saleable value of land. 7. It tends to lower the rate of interest on loans secured on lands. 8. It gives facilities for tho salo of large estates in allotments. . ° 9. Transactions can bo effected at moment's notico, and at a minimum of cout. 10. Frauds in tho purchase and sale of land are eilectually prevented, because the Certi/icato of Titlo in tho possession ot the Vcndo/ shows tho exact condition of the estate, i.e., if tho estate be mort« gaged, encumbered, or leased.
