TAND TRANSFER ACT ' LANDS ALIENATED or contracted to be alienated from the Crown in fee prior to the coming into operation of "The Land Transfer Aot, 1870," may be brought under the provisions of the Apt by application from the persons entitled thereto. All Lands alienated from the Crown after the coming into operation of "The Land Transfer let, 1870," are subject to, and must be dealt with, in manner prescribed by The following are examples, f the fee payable for bringing the land under the pro visions of the Land Transfer Act i — 1. When the Title consists of a Grant, dated on or subsequent to the 28th December, 1841, none of the land included in which has. been dealt with— Where the- Certificate of title is. directed to issue in tne name of the A ipVcant : Value of land £100 £0 11 2 Where the. Credit for Fees ia Given, When deaired by the Applicant in all cases, where the proprietor applies to have the land registered under the Aot in his own name, and the f«es may remaip unpaid until, land is. dealt with, Any person, therefore, wb.o wishes, to f his. land under the provisions of the Act. order that whenever he deals with it he be in a position to avail himself of facilities, afforded by having a Registered Titjle, can dp so Without Any Present Cost, by allowing the fees to. remain unpaid until such, dealing takes place. On all Conveyances by Deed under the old system, the cost of registration in the Deeds Registry, over and above tbe Solicitor's charge, is never less, than Fifteen Shillings, frequently rery much. more. ; while land whic.h baa heev bought under the provisions of "The Land Transfer Act" can be transferred, at atQtal cost of Eleven Shillings where a whole section is conveyed} and where only partis conveyed (and therefpre a fresh Certificate of Title is necessitated), of Thirity<one Shillings, wh^ch is the highest sum allowed by the Act,, no matter what the value or area of the land, Under the Regulations in force on and after the Ist Jannajy, 187fc> the charge for Certificates of Titles issued upon Memoranda of Transfer is reduced to. Ten Shillings, in all cases where the value of the land is. under Ten Pounds. The total cost of executing a mortgage or lease of land, registered under the. Act, is Twelve Shillings, no matter what the amount invphred. A mortgage, may be transferred or die charged, or a lease transferred or sarrendered for Five Shillings. THESE OPERATIONS INVOLVE NO ; DELAY. Tbe following are some of the ad'Tsntigea Inferred by the Land Transfer system;— 1. It secures the principal benefits and ad* vantages sought to be attained in a system of registration of deeds. 2.|lt renders retrospective investigation of title unnecessary as to all land re> gistered. ' 3. It simplifies the Titles to Real Property fwr the future 4. It makes purchasers of the fee and leases perfectly secure. 5. It siiripliiies, to tbe utmost possible extent, the forma pf transfer and tbe , modes of conveyance. 6. It increases, tiie saleable value of land. 1. It tends to lower the rate ol interest on loans secured on lands. 8. It gives facilities for the salo of large estates in allotments,. 9. Transactions can be efiectcd at a moment' 9 notice, and at a minimum oi cost. 10. Jrauda in the purchase and sale of land are effectually prevented, because the Certificate oi Title in the possession ot the Vendor shows the exact condition ol the estate, i.e., if the estate be iuort« gaged, encumbered, or leused.
