T AND TRANSFER ACI LAND 3 ALIENATED or contracted to bo alienated from the Crown in fee priqr to tho coining into oneration of "The Land Transfer Act, 1870," may be brought undci the provisions of the Act by application from the persons entitled thereto. , All Laade alienated from the Crown after the coming- intoi operation of "The Land Trangfer" Act,' 1870," are subject to, and must be dealt with, in manner prescribe^ by the Act. The following are examples f the fee payable for bringing the land under the pro visions of the Land Transfer Act:~ 1. When the Title consists of a Grant, dated on or subsequent to the 28th Decemher, 1841, none of the land included in which has been dealt with — Where the Certificate of title is directed to- issue in tbe name of the A >plicaat: Value of land £100 £0 11 2 Where the Certificate of title i$ directed to issue in the name of the Purchaser : Value of land £100 ... 1 10 0 These charges are increased by 4s 2d (Assurance Fond) for every additiona! £100 in value. 2, When the Applicant is the original Grantee, and the land has beep dealt with ; or where tho Applicant is not the original Granjiee—Where the value of the fond is £100 ... , £2 14 2 Where the value pf the land £200 8 3 4 Where (he value of the land is £§00 ... 3 12 6 Where the value of the land is £40(0 .;. 4 18 Where the value of land is above £400, the fees increase at the rate of 4s 2d (Assurance Fund) for every additional £100 in value. These charges also represent the cost of Convening Land. Inasmuch as applicants to bring Jand under the Act can direct the Certificate? of Ti&o to issue in jhe names of any other persons. Credit for Fees is Given, When desired by the Ap[ jicant in all cases where the proprietor applies to have the l&nd registered under the Act in his own name, , and the fees may remajn unpaid until land is dealt with. :, | Any persoo, therefore, who wighea to \ his land under the provisions of the Act, order that whenever he deals with it he be in a position to avail himself pf facilities afforded by baring a Registered Title, can do so Without Any Present Cost, by allowing the fees to remain unpaid until such dealing takes place. Hp will then bo in a position to Mortgage, Transfer, Lease, or otherwise deal with his land at a moment's notice. Any Title, however long and complex, may be investigated at a cost to the Applicant of only Five Shillings j for if the Title is reected all fees are returned, with the exceptior of that amount. CERTIFICATES OF TITLE ARE ABSOLUTELY INDEFEASIBLE. ALL TITLES ARE GUARANTEED B^ THE GOVERNMENT. On all Conveyances by Deed under the old system, the cost of registration in the Deeds Registry, over and above th« Solicitor's charge, is never less than Fifteen Shillings, frequently yery much more ; while land whi,ch has been bought under the provisions of " The Land Transfer Act" can be transferred at a total cost of Eleven Shillings where a whole section is conveyed ; and where only part is conveyed (and therefore a fresh Certificate of Title is iteccssjtated), of Thirity-oiie Shillings, which is the highest sum allowed by the Act, no matter what the yalue or area pf the land. Under the Regulations in force on and after the Ist January, 187fc, the charge for Certificates of Titles issued upon Memoranda of Transfer is reduced to Ten Shillings in all cases where the value of the land is under len Pounds. Tho total cost of .executing a mortgage or lease of land, registered under the Act, is rwelve Shillings, no matter what the amount involved,. A mortgage may be transferred or dis;hargeu) or a lease transferred or surrendered [or Five Shillings. TfIESE OPERATIONS INVOLVE KO DELAY. The following are some of the acl-7WBtigeß »?nierred by the Land Transfer sys^ ja :— 1. It secures the principal benefits and advantages sought to be attained in a system of registration of deeds. 2,'|l* renders retrospective investigat/on of title unnecessary aa to all land re gistered. 3. It simplifies the Titles to Real Property for tho future 4. It makes purchasers of tho fee and leases perfectly sepure. 5. It simplilicg, to the utmost possible cxteiit, the lorma of transi^ and the modes of conveyance. 6. It increases the saleable value of land. 7. It tends to lower the rate oi interest on loans secured on lands. 8. It gives facilities for the sale of large estates in allotments. 9. Transactions can bo eHectod at a moment's notice, and at a minimum Oi COfit. 10. Frauds in the purchase and sale of laud are effectually prevented, because the Certificate of Title in the possession oi the Vcndo/ shows the exact cotiditiou of tho estate, i.e., if the estate be iuort» gaged, encumbered, or leased.
