DISPUTE HEARD IN COURT JUDGMENT FOR THE CARRIER A dispute over the price of metal delivered by a Hauraki (Plains carrier to a Kerepeehi farmer was ventilated in the Paeroa Court before Mr W. A. Freemap, S.M., on Monday when D. Waugh claimed £1 Us 3d from J. J. Jenkins. Waugh in evidence stated that Jenkins %had obtained a price,of Ils per yard for metal from him and had then ordered a number of loads. He had rendered the account and in due course had received a cheque in payment but the cheque had been £1 Us 3d short. Jenkins had written quoting another carrier’s price for metal but he had not bothered to reply as he had given a quotation before he delivered the metal and Jenkins need not have accepted if he could have got the metal at a lower price elsewhere.

Jenkins; in stating his side of the case said he had Waugh bring him a load or two of metal to fill in a gateway and then told Waugh that if he would reduce his price he would take further metal. To assist Waugh he had told him to deliver the metal at his own convenience. He claimed that Waugh had agreed to cart the metal for 35s per load, not 38s as charged-. The Magistrate entered judgment for plaintiff with court costs 12s.
