THOSE PIGS!
THEIR FINAL DEBUT. A PENALTY IMPOSED. The pigs which have been causing all the trouble out Awaiti way appeared by proxy in court again on Monday, when Mr F. W. Platts, S.M., handed down his written decision from the hearing held two months ago. On that date, August 12, B. J. Coldicutt (Mi* C. N. O’Neill) applied for £73 13s trespass rates against W. P. Handley (Mr R. S. Carden) in respect of the alleged trespass of defendant’s pigs over complainant’s property at Awaiti. At the conclusion of the evidence the magistrate announced that he would give his decision at a later date.
On Monday, in handing down his decision, the magistrate said it had been proved that the defendant’s pigs had trespassed on the plaintiff’s land over a very long period, and the evidence also showed that pigs of other owners had trespassed on the plaintiff’s land. Allowing for this, he allowed £l5 in respect of those trespasses which had been proved. Plaintiff had sought to recover double trespass rates under the provisions of section 14, sub-section 1, of the Impounding Act, but the magistrate said he considered plaintiff’s evidence did not support his claim in this respect. Damages to the amount of £l5 would be allowed, together with £2 2s solicitor’s fees, witnesses £1 15s, and Court costs 12s, a total of £l9 9s.
