SUED FOR DEBT.

SHARES IN BREWERY COMPANY.

ORDERS REFUSED BY BENCH.

At the July sitting of, the local Magistrate’s Court, which was presided over by Mr S. L. Paterson, S.M., the Paeroa, Brewery Co., Ltd., proceeded against D. W. Robson, P.ap'roa, on a judgment summons, claiming £3O 16s 6d. There was- no appearance of the judgment creditor, ait that sitting and the case was struck out with costs against the company.

At Thursday’s sitting of the Court, beefore Mr F. W. Platts, S.M., an application by Mr E. A. Ponr;itt op behalf of the company for a re-heaTing was granted. In evidence Robson stated, that judgment had been given against him in September, last, and since -then ■his earnings had amounted to about 30s a, week, out of which he had to feed and clothe himself. At the present time he was manager of hi B brother’s grocery business'.

To Mr R. S. Carden defendant said that the grocery business had been assigned some months ago, and he wa,s. not in a position to make an offer.

The magistrate said that-the posirtion was apparently a hopeless onie-, and under the circumstances he would not make an ordeit

The Brewery Company als;o v proceeded against Fred Ngawiki, of Tirohia, claiming £54 12s 6d.

Ngawiki stated that he was farming, and the property brought him in about £2 a week. As a licensed' interpreter his earnings amounted to about £l. The farm was practically unimproved, and only five cows, were milked. The debt represented shares' in the company, but they were valueless. The magistrate said that there was not enough evidence to warrant an order being made, and the case would be struck out.
