APPLICATION FOR PERMIT.

BOROUGH COUNCIL DISCUSSION.

At, the June; meeting of the Paeroa Borough Council a l.ocal solicitor, .acting on behalf of a, fishmonger who has premises, ip Belmont Road, applied for permission to erect, a wooden and toon shed at th© back of his premises for the purpose of using it for fishcuring and smoking; the shefl to be 12ft by 6ft, and. situated inside the brick area on the extreme south-west-ern side of the section and erected at an estimated .cost of. £5. At that meetling tlie ma.ttei'' was referred to the health and building committees for a report.

At th© council meeting op Thursday night the committees submitted the following report “Your committee begs to report having inspected the; proposed, site. The applicant advised that a- plan was being prepared for, a building of brick, and this plan has b,ee.n submitted to the building committee, which finds, that it. is in order. “The matter now rei-olves itself into a health question, for under, the Act the curing on smoking of fish is deemed an offensive trade. Under £;ect'on 54 of the’ Health Act it is unlawful to establish an offensive trade without the consent in. writing of the district medical of health, .as well as the consent of the local authority. We therefore suggest that the application be forwarded to Dr. Chesson, and that his, vie,ws fye obtained before any further action is taken.”

The Mayor said that the committee was taking the proper course. Cr. Edwards explained that, it was not intended to carry on a fish-curing business on a big scale, but fish would be cured to save it from going bad i.nJ thd shop during the summer. Such small buildings were allowed at. Tham.es and Newmarket, and he considered that the application should be granted.

Cr. Hare said that the committee had no wish to hamper a man’s living, but the site was qu'ite; .unsuitable.

Cr. Pinder agreed, and said the shed wopld be in close proximity to a dwelling, and in the opinion 'of the health inspector the medical officer of health would not approve; of the site.

Cr. Turner said that the shed was required for preserving fish unsold in the shop, and in his opinion it would be better to allow the applicant to smoke the fish, than to let it go bad. Tlie Mayor said that it was .useless beating, the air, and he moved that the application, be for.warded to the medical officer of health, that that a.ll 1 the circumstances be fairly pointed out. This course was agreed to.
