THE CRIME AND THE PENALLY.
A NEW SOUTH WALES DECISION.
Many people will find something to mai-vel at in the magisterial decision of Mr Chapman, of Wollongong, New South Wales. He 'had before him a man charged with a particularly brutal, assault. The offender—;a.n oldoffender, with’, two assaults against, women to his discredit —had used a stick to batter his victim into insensibility. To give a further, lurid touch to the proceedings it is mentioned that the injured man was, held down by someone while the battering took place. The ruffian who committed this outrage, which might easily have resulted in death, was spoken to severely, and let off with a fine of £B. If the magistrate ctonsiders that conduct adequately met by a fide, what does he think worthy of gaol ? (asks a Sydney paper). The case, on the facts published, looks like a glaring miscarriage of justice.
