At the Christchurch Magistrate's Court last week, before Mr H. A. Young, S-M., Schumacher claimed £lO 18s from the Sun Newspapers, Ltd. Mr Cuningiham appeared for plaintiff and Mr Hutchison for defendant company. It was set out in the; statement qi claim that on June 28, 1927, plaintiff complied with all the conditions necessary t>o entitle him to the benefits of the “Sun’s” free insurance scheme conducted by defendant company, and that on September 18, 1927, while en- ■■ gaged in a game of sport, to wit football, plaintiff injured ihis right shoulder, and such accident caused the; temporary partial disablement of plaintiff for two weeks, and necessitated an expenditure ofi 18s in X-ray and hospital fees. Plaintiff claimed that he was entitled under the “Sun’s’ free insurance; scheme to £lO 18s, and had applied for payment of, i this amount, which bad been refused. Plaintiff said that on September 18, with a number of other youths, lie was playing football on a paddock in Riccarton. He slipped during the game, injuring his shoulder. The game took place on Sunday. Plaintiff tiff was wearing his ordinary clothes, and there was no referee. There were no goal-posts on the field,. Mr Cuningiham said that the offe,r of the “Sun” was wide and emphatic. If it were intended that the offer should be confined to the meaning counsel for the defence had given it, that should havci been made clear by tihje “Sun” in its offer. “These young .fellows were playing a game of. sport, and they were playing according to the rules,” said Mr Cuningham. Judgment was given for plaintiff, with costs, the magistrate holding that plaintiff was engaged in a game of sport.
