BREACH OF BY-LAW.

ITINERANT TRADER CHARGED.

AN ADJOURNMENT GRANTED.

At the Police Court, Paeroa, this morning, before Mr G. P. Lamb, J.P., D. Livingstone was charged, with being an itinerant trader within the meaning of the Paeroa Borough Council by-laws, and that on September 7 he offered goods for sale- within the borough without a license authorising him to do so and signed by the town clerk, as required under by-law No. 1 of Part M. Mr C. N. O’Neill appeared on behal of the council and Mr E. A. Porritt appeared for the defendant, who did not attend the Court. Mr Porrittt explained that he had been instructed to appear for the de- ! fendant by a firm of Auckland solicitors only that morning. The defendant wasi travelling about the country and his solicitors had not had time to prepare a defence. An adjournment was sought, so as to give; the defendant’s solicitors an opportunity to obtain a copy of the by-laws, and look into the matter. Mr O’Neill said that he did not wish to take the defendant unawares, but pointed out that he had had a week in which to prepare his. defence. However, in deference to Mr Porritt’s application he would not oppose an adjournment, so long as his costs were paid on the adjournment. Mr Porritt agreed to the request, and an adjournment was accordingly granted until October 3, when the case would be heard before Mr F. W. ( Platts, S.M. The by-law under which the charge is laid reads: “No itinerate trader shall sell or offer, or expose for sale, any goods, articles, wares, or merchandise whatsoever, in any part of the borough, without a license auth- ' orising him so to do, signed by the town clerk.”
