MAGISTRATE’S COURT.
JUDGMENT SUMMONSES
DEBTORS EXAMINED BY BENCH.
At the Magistrate’s Court, paeroa, before Mr F. W. Platts, S.M., on Monday last, Robert Gage was called upon a judgment summons to pay C. W. Watts (Mr Carden), Hikutaia, the sum of £5 6s lid for groceries supplied.
Gage, in answer to Mr Carden, said that he had not been able to pay anything off the account, as his earnings had only been about £3 a month recently. He received one-third of the factory cheques, no pigs, and no bonus. He was working for Mr H. R. Bush, and had not been able to get a job off the farm. He had a wife and four children to keep, and was not in the habit of frequenting hotels at Paeroa.
After further examination the magistrate said that he could not grant an order.
AN ORDER REFUSED.
Messrs. J. B. Mac Ewan and Co. (Mr C. N. O’Neill), Auckland, sued D. T. Clotworthy, Hikutaia, on a judgment summons for £72 9s 4d incurred in purchasing some machinery. In answer to Mr O’Neill Clotworthy said that his earnings as a, drover were, very small since judgment had been given against him. During June his earnings were about 21s, and in addition he had milked a., few cows. The firm had taken the machine back, and lie submitted that he did not owe anything on it. In striking out the case the magistrate directed the defendant to consult a. solicitor. It was unreasonable to go on receiving accounts for the machine after it had been taken away. ORDERS MADE. A young married man, named J. A. Spencer, was sued on a judgment summons to pay Mrs E. Nelson, Karangahake, the sum of £3 6s
Debtor, a labourer, Paeroa, said tha.t since February 15 his earnings had been approximately 14s a day. He had two children.
The magistrate suggested that Im should make an offer and save going into his private affairs. Mr Carden : Will you pay 7s 6d a weelk ?
Debtor : Don’t be too hard I Mr Carden: Will you pay 5s a week ?
Debtor : No. Make it 5s a month. The magistrate remarked that the offer was absurd, and directed the examination to proceed.
To Mr Cardefi debtor said that his earnings did not balance his outgoings.
The magistrate said he' thought debtor could pay 5s a week if he tried. An order would be made f° r payment at the rate of 5s a week, the first payment to be made by August 8, in default three days’ imprisonment.
On a judgment summons' H. L. Lewor, bainter, Poeroa, a married man with four children, was ordered to pay E. Powell £ll 17s lOd at the rate of 10s a fortnight, in default five days’ imprisonment.
