OHINEMURI LICENSES.

SITTING OF COMMITTEE. CONTINUATION OF EVIDENCE. The Licensing Committee continued to consider applications for licenses on-Wednesday afternoon, the following being dealt with : — STERLING HOTEL, WAIHI. Mrs Medora Stephens, widow, Waihi, applied for a license in respect to the premises at Waihi know as the; Sterling Hotel. Mr J. McVeagh appeared ’for the applicant, and stated that the husband of the applicant had been the owner of the hotel at the time no-license was carried. Therefore a preference license was sought. Mrs M. Stephens said that, the Sterling Hotel had been removed to Waihi in 1895 from, she thought, Hikutaia. In 1900 the building was leased to Campbell and Ehrenfried, ivho retained the premises up to 1909, when nolicense was carried. Some years later it was destroyed by fire. If a license wti.s granted she proposed to erect a new and commodious hotel opposite tlie present premises. Mr McVeagh submitted that a similar position obtained where a licensed building had been destroyed by fire and the license had been transferred to temporary premises. The chairman explained that the Bench did not doubt that the applicant had certain rights under the. 1910 Act, but the granting of a temporary license for the present premises did not appeal to the committee., and there was no guarantee that the new premises would be. gone on with. The Bench did not desire to dismiss tlie application, but it would not be granted for the present premises. The; matter .could stand adjourned with the annual meeting. An indication as to the granting of a license, for new premises would be; advised in due course. In the meantime the applicant would lie well advised to make fresh application for .the new premises.

. RAILWAY HOTEL, PAEROA, The executors of the estate of M. iA. and E. F. Moriarty applied for a license, in respect to the Railway Hotel, which it was proposed to erect. Henry Isaac Spinks was named in the 'application as prospective licensee. Mr F. D. McLiver, Auckland, for the applicants, asked leave, to 5 withdraw the application in favour of Robert Emmett Bradley. He explained that all the requirements, had be;em complied with in 'regard to Spinks, but a certificate of fitness had not been granted. An amendment of the application was asked so as not to jeopardise the possible granting of the license. In answer to the Bench Mr McLiver said that in regard to advertising for the new applicant, that could be done as the Bench directed. Bradley had at one time, been licensee of the Prince Arthur Hotel, ’Auckland. Section 292 of the Act was, the authority on which he submitted the fresh application. Inspector Willis quoted authority against the granting of a. new application..

The chairman pointed out that the irregularity rested on Spinks not being granted a certificate eJP fitness. The Bench was prepared to accept the application provided it was advertised at least twice before the adjourned annual meeting. Strictly speaking, evidence, required to. be taken at that meeting. Mr McLiver said he would prove that an hotel providing accommodation adjacent to .the railway station would be a decided acquisitim. Regarding the preference claim, Mr Moriarty had been a. licensee of the Paeroa Hotel at the time no-license was carried.

H. I. Spinks said that he had been associated with the Paeroa Hotel, during the time, of license. He remembered Moriarty using a section and sheds thereon in conjunction with the licensed premises. R. E. Bradley said that he had held a number of licenses in Auckland and Thames, and had never been convicted. Eileen E. McLiver said that she was executrix of her parents’ estate Shq detailed the acquisition of the section of the buildings thereon.

In answer to the Bench witness said that her father had purchased the section during the time he had the lease of the Paeroa Hotel. Mrs Crosby, the late lessee, had always paid rent to .the estate for the use of the section and buildings. The application was adjourned to June 18.

WAIKINO HOTEL. Messrs Campbell and Ehrenfried, Auckland, being owners of the Waikino Hotel when no-license wa f s carried, applied 'for a license, submitting Williiiiin John Selwood, of Parnell, as licensee, Mr R. McVeagh appeared for the applicants and explained that the house was in course of erection, but it would be completed in about 15 days’ time. The trend of feeling and a desire for licensed premises at Waikino were evident by the fact that the figures in favour ofr restoration at the last election were 211 against 105. Mr Bartley, architect, Auckland, said that the old Mackaytown hotel had been removed .to Waikiim. The timbers were particularly sound, a, nd alterations and renovations were well under way, in addition to the erection of a new wing and balcony. , Decision was reserved until June 18. KARANGAHAKE HOTEL. The. application of Guiseppe S. Rossi for a license for a house at Karangahake was withdrawn, a.s a certificate of fitness had not been granted.
