An interesting case claimed the attention of the Magistrate’s Court at Thames ini Wednesday last, when Janies Lennon and his wife proceeded against Archibald McCarthy for a breach of a particular contract and claimed £lO damages. Mr Garland appeared for Lennon and Mr Clendon for McCarthy. It was stated that McCarthy arranged to run a launch to Waitakaruru on Christmas Eve at 6 p.m., and instead lie left at 5.40 p.m., and Lennon, his wife, and family were left behind. After hearing the evidence His Worship gave judgment for plaintiff for £5, with costs £l4 3s 3d.
When a case of alleged obscene language is being heard in Court the alleged words are always written down on paper and shown to the different witnesses in the case, who have to affirm tp the accused person having used such. Thus the words are never spoken. In a ca.se at Palmerston North the Court received rather a surprise, and stared a little when a female witness of Maori origin, questioned as to whether the accused person had used obscene language towards- her, repeated loudly the words alleged to have been used, and then said them again immediately—to make’t quite clear. The next witness was given pencil and paper.
