IMPOUNDING OF CATTLE.
WAT THE SETS OUT. The powers conferred upon poundkeepers are not generally understood. Information on the terms of the Act was provided by the clerk to the Waipa County Council at Monday’? meeting. Mr Bowden said that a'pduridkeeper was an independent officer, and not the servant of the local authority that appointed him. Therefore the local authority was not answerable for any misfeasance on the part of the poundkeeper. In the case of each sale of impounded cattle sold under the Impounding Act, 1908, the proceeds of such sale shall be applied in payment of (1) any costs and charges attending such sale ; (2) of all sustenance fees payable in respect of the cattle ; (3) of fees and charges payable into the district fund in respect of the cattle ; (4) to the impounds/- of such cattle of rates due to him for the trespass thereof and the charges for driving same to the pound. Tne residue, if any, shall be payable tp the owner of the cattle, unless (1) if within 14 days after anv pound sale any person entitled to any trespass rates op tp any residue of the proceeds of such sale has not claimed payment thereof the poundkeeper shall pay the amount <?f such trespass rates or residue into the district fund; (2) such payment into the district fund shall not prejudice the right of any person to the amount so paid or any part thereof, provided that if such rates or residue are not claimed by any person entitled thereto within one year after such sale the same shall form part of the district fund.
