MAGISTRATE’S COURT.

MONDAY, APRIL 9, 1923. (Before Mr J. H. Salmon, S.M.) At the Magistrate’s Court on Monday judgment by default was given in the following cases : D. W. Robson v. T. Wilson, £2O 6s 6d, costs £3 Is ; D. A. Vincent v. W. Hart.. £6 15s 3d, costs £1 15s 6d ; Harnett and Blundell v. P. N. Aro, £2 8s 7d, costs £1 8s 6d ; E. W. Porritl v. J. Toby, £lB 15s, costs £2 19s JU DGMENT SUMMONSES. W. J Ellis claimed from D. Ryan £5 2s 9d for work done and goods supplied between April, 1919, and January, 1920. An order for payment forthwith was made, in default five days in Thames Gaol. Costs allowed were 15s 6d. W. .1 Potter, as liquidator for Hague Smith, Ltd., claimed £3 6s, for goods supplied to George Wilkinson. An order for payment was made, debtor to pay off £1 every four weeks, commencing from May 1, 1923 ; i'l default two days in .Thamec Gaol. R. Whitten (Mr Pprritt,) claimed £3l 10s, balance of rent, and costs, from H. D. Sorensen. Sorensen, sworn, said he admitted that judgment went against him in his absence in September last. He had not paid lent because he was rated at 15s per week, whereas the amount should have been 10s. He had been doing work for Bertelsen, erecting a sawmill on contract, and had lost money because he could not get the material. Defendant admitted going to the Te Aroha races, also the Thames races, and had attended on both days at Paeroa. He denied having gambled on the totalisator. He had. been given complimentary tickets and had only taken a few shillings to each meeting. He denied that he had refused to work for Bertelsen, preferring to go to the races. Defendant, said he had only earned about £3 since Christinas, and was not in a position to pay anything off the debt at present. He had a wife and eight children to keep in Te Kuiti. They were at present living with his son-in-law, as Whitten had turned them out of the house. To His Worship defendant said the account rendered was ndt, correct, as he owed rent at the rate of 10s per week. An order was made for payment forthwith, in default 28 days in Thames Gaol, the order to be suspended so long as debtor paid £1 a month, first payment to be made on May 9, 1923. Costs £1 Ils 6d.
