POWER STOPPAGES.
CLAIM BY DAIRY COMPANY. —- I QUESTION OF RESPONSIBILITY. Mr W. Morris, superintendent, N.Z. Cooperative Dairy Co., Hamilton, writing under date 2'nd ir.st. to the Thames Valley Power Board, stated : ‘‘We have yours of February 20, with reference to our claim for stoppages at our Waitoa dried milk factory. We note the attitude that you are adopting in the matter, and we now wish to advise that the whole position relating to the supply of electrical power must, be seriously considered by us. Although at Waitoa we hare had little trouble since November, the position at Waharoa has not been satisfactory, and we have details before us from the factory manager where during January 25 and February 2 some considerable loss was fticurire<l through the unsteady supply of power. We are investigating -this matter further, and will write when our investigations are completed.” The chairman said it would be best to wait until the Board heard further from the company. Mr P. Gilchrist, the Board’s solicitor. submitted the following advice: “You are not liable. No person who is a consumer of electric energy supplied by the Board should have anv claim against the Board in the event of any failure of the supply of any such energy through accident, drought, or other unavoidable cause. This I consider applies to all consumers, whether ordinary or by agreement.”
