WARDEN’S COURT.

A DISPUTED CLAIMS FORMER APPLICANT WINS. (Before Mr J. H. Sahnpn Warden.) The Warden’s Court was occupied for some time yesterday in hearing a disputed claim for ground at Karangahake, being a part of land recently held by the Crown Mines.. Limited. At the last sitting of the Court an application by Ratliff and [arty was thrown out on the ground that the claim was insufficiently. pegged out. The same area was again pegged out by the former applicant, and also by W. A, Greaves. Mr Pbrritt appeared for the former applicant and Mr Hanna for tihe latter.

Tn his evidence Mr Greaves said the ground was part Of* the Roderick D’hu an l contained approximately ’8 acres 10 perches, and the application was lodged on August 25, 1922. He pegged all the angles and produced a plan showing the pegs. He claimed that it was impracticable to put all the peg« in owing tp the precipitous nature of the country. Five pegs were put in, and he defined their positions on the plans. ’

Mr Porritt, for the Objectors, Ratliff and party, said that the case must fail as only five pegs had been put in and there were pine angles to the" property.

3. S. Ratliff, one of the former applicants, in giving evidence, said that one peg ,was on the Woodstock claim, and from a plan showed the Warden the position of the pegs he had put in.

H. W. Lloyd, miner, said that he knew the country and assisted to peg out the ground when it was originally surveyed tor the Crown Mines by Mr Adams. He had inspected Ratliff’s pegs and thought the ground pegged out. The Warden said that it was futile to put the parties to the expense of •a. survey. Greaves had admitted, only putting ip five pegs, and had not fulfilled the condition of pegging. He ruled that the objection of Ratliff and party must stand, as they had. complied with the pegging as required by the regulations. He allowed nominalcosts, amounting to £5 45.. >
