MAGISTRATE’S COURT.

TUESDAY, MARCH 31, 1922. (Before J. H. Salmon, Esq., S.M.) Judgment by default was given in the following cases at the court yesterday : A. Cassrels v, W. H. Fisher, claim £2O 10s 2d, costs £3 Is, and an order for possession on April 21; L. G. Martyn v. D. T. Clotworthy, claim £2 10s, costs £1 Ils 6d ; Morgan Bros, v. J. N. Reed, claim £1 13s, costs 9s; E. W. P.orritt v. Hori Metua,, claim £6, costs £1 18s 6d ; Public Trustee v. C. Caisley, claim £2 10s 2d, costs £1 6s 6d ; Fleming and Son v. The West Coast Iron Sand Smelting Company, claim £147 Is Bd, costs £7 7s.

In the case of J. Pennell; v.. R. Whitten for impounding fees,, judgment was given by consent for £3 16s and costs £2 13s 6d In a defended action, J. L. Hanna v. J. Handley (junr.), judgment was Entered for £4 4s, and costs 82 7s. Hazar-e Singh v. N. S. Davidson. This was a claim for £lO2 for clearing rushes,, etc. Mr Porritt appeared for the plaintiff and defiendant • conducted his own case. Mr Porritt! said that, this was a friendly action, and was brought simply for the magistrate tp decide the amount to be paid. He asked for the case to be adjourned to April 26. The defendant! said he was willing to go on with the case, and had brought; his witnesses. The Magistrate said that defendant was certainly entitled to witnesses’ expenses on the adjournment, and granted him £3 12s. • In a case brought by Koi Takaioa against D. Benner in which the plaintiff did not appear, the case was struck out;, with costs against plaintiff for 16s. JUDGMENT SUMMONSES. T. Richards v, J. King, claim £24. Defendant was ordered to make payment forthwith, in default 24 days’ imprisonment in Thames Gaol. E. W. Porritt v. Rekirangi Tiunga (Dick Paul), claim £35 2s. An order was made for payment to be made forthwith, in default 35 days’ imprisonment. qi Auckland.
