RELEASE ORDERED
BY IRISH COURT
O’DUFFY’S ARREST NOT LEGAL.

DUBLIN, December 22
In the Irish Free State High Court Mr Justice O’Byrne ordered. General O’Duffy’s immediate release. He said that it was impossible to conclude that Superintendent Murray’s reason for the arrest was the suspicion that O’Duffy was ~a member of an illegal 'organisation; The Public Safety Act conferred wide powers on the police, and it must be construed in the way most favourable to the liberty of ■ the subject. The only reasonable inference wa s that the men were arrested for the wearing of blue shirts and for attempting to- address a meeting.
The Judge said: . “L am satisfied that the Act provides for no arrest in such circumstances.”
Mr Justice O’Byrne granted both General O’Duffy and Sullivan their costs. Both were loudly cheered on leaving the gaol. It . is understood that General o’Duffy and Sullivan will be re-ai" rested and tried by the Military .Tribunal, The charge arises from their being suspected of belonging to an illegal organisation,
