FARMER OPPOSES CLAIM

THAMES, July 22. A case of considerable interest to Crown tenants was heard in the Magistrate’s Court yesterday, when the Hauraki Plains County Council sued Joseph James Jenkins, fanner, of Kerepeehi, for the recovery of £l2 14s 2d rates. Mr Hammond, for the council, said that the case wag a test one to determine the liability of temporary Crown tenants to pay rates. Defendant held grazing rights over a block of Crown land, and had previously paid the rates, but now questioned his liability. Mr O’Neil, for defendant, said that the question of law turned on the liability of an occupier of Crown land to pay rates under section 130 of the I; a nd Act, 1908, which was identical with section 147 of the 1824 Act. He submitted that the land was held under license, and the fact that defendant held grazing rights only did not make him an occupier within the meaning of the Rating Act, The quesion was not new, but there were no previous judicial decisions covering the particular point. Judgment was reserved.
