PRISONER’S REQUEST
LASH INSTEAD OF GAOL REFUSAL BY JUDGE An extraordinary request was made to. the Court of Criminal Appeal in Melbourne recently by John Barclay one of two prisoners who escaped from a prison van while being taken to Pentridge gaol this year, “I appeal ,to.you to give me a flogging,” said Barclay, “not a small .flogging of 10 strokes or so, ‘ but a severe flogging of 50 strokes or more. I want you to realise that I am sincere. I am not. making an heroic gesture. I know that flogging is a severe punishment. It hps been described to me as a little short of torture.”
Barclay asked for the flogging instead of a long term of imprisonment. He appealed against a sentence of imprisonment for five years imposed by Judge Winneke for having, while armed with a pistol, robbed Miss Eileen Ileinze, jeweller. Two years of the sentence were made concurrent with other sentences which had been imposed on Barclay previously.
“I am only a, young man,” Barclay Rgid, “and by the time I come out of gaol I shall be at least 36 years of ago.” The Court refused to disturb the sentence and said that Judge Winneke might hare inflicted q more sever© penalty.
