Counsel for the defendants informed the Court' that no further evidence would be called, - ■■ ■*,
The Chief Justice said that, on .the case as it stoqd ' lie was, prepared, to - pronounce for the validity :of the will and the two ' codicils propouned by,; the executors.
Judgment was (entered (accordingly and the terms of settlement, other than the pronouncing of the validity of the will and codicils, were made a rule of the Court.
After announcing the terms, Mr Watson said that pursuant to the settlement, the defendants (Mrs Dunn rnd Airs Cowles) withdrew their allegations made against Mrs Galbraith.
The Chief Justice said he saw no sason why he should not pronounce in favour of the will and codicils. It would have been quite impossible to find there had been any undue J influence. He thought it his duty to say that the charges aganist Mrs Galbraith hacl very properly been withdrawn, Dealing with the question of testamentary capacity, HE Honour, said the letters written by the testator during the crucial . period appeared to him to be bone fide letters, and, on the evidence that had been adduced, he felt he would not be justified in drawing any other conclusion. . v
