N.S.W. REFERENDUM

APPLICATION IN EQUITY COURT,

SYDNEY, ’May 19,

The application came -before the Chief Judge in Equity, Mr Justice Harvey, fio r an inieiim injunction restraining tile N.S.W. State Electoral Commission, Juuge Edwards, from issuing a certificate concerning the result of tile voting in the recent Legislative Council referendum.

Mr Loxton, K.G., for tins applicants, in the course o-f his preliminary arguments, claimed that important constitutional issues aie involved,-similar to those argued on a former occasion, when the fate of the Upper House was in the balance before the Privy Council.

Mr Justice Harvey admitted that possibly some such issues would arise. He would, therefore, invite two other judges of the Supreme Court t-o join him in the bench.

In the' meantime,. Judge Harvey said he would grant the interim injunction until Thursday of next week.

Mr Lex ton intimated that his main ground for objection was that the Legislative Council Reform Bill had not been properly submitted to the electors, and that the Privy Council had laid it down that every elector must have a full knowledge of the contents © Referendum Bill before he or she could register his or her vote validly,
