MAKING WILLS
CRITICISM BY A JUDGE. 'Short’d an elderly man be allowed ' • !I ! | , , to leave bits money to a nurse, and an old' lady to leave hers to a youth who ■half danced attendance on her? A critic, i-m of th c law which permits wills such as th?s e made recently by Mr Justice -Maugham at a Lincoln’s Inn Hall lecture has started a lively controversy in London legal circles. , The■ judge, speaking as a citizen, expressed th e view that the law should be a method of setting aside grossly unfair wills.
Some lawyers agree with him; others do not. Mr Harry a London solicitor, i t s on, e who thinks there is is .no need to change the law. “Why should not an old man be allowed to leave his money to his nurse or to any one else?” he said. Such a will could be ups e t if the nurse had exercised undue influence, or it there i, s evidence that the testator was not in his normal mind.”
