AN APPEAL DISMISSED.

LONDON, December 7

Th-e Privy Council has dismissed the appeal of “Truth and Sportsman,” Sydney, arising out of the action for damages by Dr Thompson, also of Sydney. " • ’

In its issues of March 3. 1929, “Truth’-’, published a- report cf a case heard at the Small Debts Court, Sydney, in which 'Dr George Stanley Thompson, of Macquaria Street, city, and Coogee, was’'claiming certain moneys frbm \Y. H. Vernmer, trading as the Commonwealth Commercial Services, and Dr Thompson alleged the report of this case was defamatory of him, and on March 12, 1929, started an action against “Truth,” claiming £SOOO damages.

On the hearing of the action the jury -returned a verdict for “Truth,” and from this tin* plaintiff appealed to the Full Court of New South Wales ■ asking for a new trial, which was granted. 'Subsequently, the Full Court refused to leave the defendant company to appeal to the Privy Council from this deoison, and on. the second trial of the action the* jury returned a verdict for the plaintiff for £3OOO. From this verdict the defendant company appealed to the Full Court of New South Wales, which dismissed the appeal, following which the defend"nt company appealed to the Privy Council against the decision of the Full Court.
