The retrial of Heta Fred’ Gardner, aged 15, on th s charge of murdering ■an old nun, George Crewe, at Ruatengata last 'May,' began to-day. The jfiry disagreed at the first trial, and, since then, a statement ’was to the police by accused, which has been held by the Court- of Appeal to be inadmissible as evidence. The actjng-Crown Prosecutor told tlie jury to-dijjy, that,, while accused had not been 'declared ’ in-'aue, be hind been judged not altogether normal.' Perhaps lie was best described an feebleminded, but the question for the jury was whether he •committed the c-rinie or not. .There their responsibility ended.
