APPEAL COURT

ALEXANDER MINES -CASE: (Per Press Association — Copyright.) WELLINGTON, October 28. The Appeal Court. to-day delivered judgment in the me of Alexaur’u Mines Ltd. y. Hill and MeVicnr, which wins heard before the Full Court on 4th. and sth. instant. Judgment was to the effect that the plaintiff Oomoany, in declaring and paying dividend’s, .should do so accordingly to the amount of subscribed capital held by each member of the Company. Justice Herd man dissented from the judgment of the other memnevß of the Court, holding, in his opinion, that payments should he made according to the amount paid up on the shares. No order was made as to cost*?, counsel for the company intimating ._*« client had undertaken to pay the costs.
