AN APPEAL

DECISION RESERVED. (Per Press Association — Copyright.) ' AUCKLAND, October 11. Justice Smith to-day heard an appeal of Auckland Transport Board against the/ decision, of Magistrate Hunt, in a case in which three taxi drivers were prosecuted for plying for hire without a certificate 1 of fitness under / the Transport Licensing Act. The drivers on race day carried passengers from Epsom .racecourse. Fares were assessed separately, but the total amount was collected from one passenger. Mr Hunt ruled that yno offence had been committed. Counsel for the. Board .argued that taxi drivers were not permitted to charge separate fares vvithout being licenced. Counsel for the drivers contended that taxis were excluded from the Act, no matter on what system fares were charged. His Honour reserved his decision.
