The case concerns the admissibility of certain evidence tendered toy the lOVown at the trial of Heta Fred Gardner, who was indicted at Auckland in August last with the murder of, one George l Crewe a,t Ruatangata on or about 27th May, 1932. At the hearing, some of this evidence was admitted and' some was excluded hy 'the ■'trial judge. The jury were unable to agree upon a verdict and a ; new trial was ordered.
