QUESTION OF EVIDENCE. (Per Press Association — Copyright.) ' WELLINGTON, October 6. The- Court of Appeal, consisting ot the Chief Justice (Sir M. Myers) and Justices Herdman, MacGregoi and (Kennedy, 5T engaged in hearing argument on’ a case''stated for opinion by Justice 'Smith, under th© provision of Section 442 of the Crimes Act, 1908. The case concerns the admissibility of certain evidence tendered toy the lOVown at the trial of Heta Fred Gardner, who was indicted at Auckland in August last with the murder of, one George l Crewe a,t Ruatangata on or about 27th May, 1932. At the hearing, some of this evidence was admitted and' some was excluded hy 'the ■'trial judge. The jury were unable to agree upon a verdict and a ; new trial was ordered.
, Oft is sought to obtain a ruling of the Court of Appeal, on the admissibility of the evidence, before the second trial'is instituted.
