Counsel for objector said that applicant, as a director of a company, coyld not obtain a concession for liiß own interests if it were not in the interest of ' the Company for him to obtain it. Applicant’s pegging of the claim was also at fault, as three of the pegs were on lain area for which a license .was already held. James Stanley Langford said he; organised the Company known as Callaghans’ Goldmining Co., and the applicant knew that he 'was going to Nelson to finance - the’ concern.' • The ' : principal capital was obtained w Nelson, and applicant had received a considerable sum for his land, as well ,as being appointed ® director of the Company. The, Company later puraa>Cffl>*hieh~ newed last year in his (witnefw’) name, as trustee' for the Company. On August lffth, last year he received the grant, md fourteen! days before the expiry on August 18th;, 1932, the Company instructed counsel to lodge fresh application for the area of 20 acres which was done so in his name, whioh was the area applicant. now sought a. license for; There _ was no doubt that the Company desired the renewal of the 20-aore block. On this area Havill had only one peg whioh - was on the bounda,ry, the other three being on this, adjoining block. Has Company was the owner of all the - areas adjoining the 20 acres, -well as the water Tights. If applicant v necured itilie license at would lufiftf? the scope of the Company’s work. Ap- >; plicant’s son was. the working manager for the Company, and was engaged on the ground, /, >,•; To counsel for applicant, witness said that his Company intended to apply for a renewal ~-v , , . To counsel for objector: Applicant j was a director of the Company when he pegged out the area?—Yes. David Miller Pettigrew, dredgemaster, of Hokitika, said the granting of the application would be detrimental to further sluicing operations. Applicant said that he - became a director of the Company since December 17th., 1932. He pegged out hia claim on the day following the expiry of the Ojioense. Ijijior to going out he was told the tarea was open for application. I Mr-Murdoch: Although a director of the Company to whom you sold .property, (for which he had go far received £800), . you . did not inquire ; from your Company what land it held in this district? —No. ,• ... You knew the license had expired on August 18th., that Mr Langford the holder, was the agent of the Company which bought you out?—Yes. Why did you not inquire from your son regarding the particulars of the Company’s areas ?—Lfc did not concern hipu The Bench adjourned its decision. ■ An application ■ for an ordinary prospecting license was made by J. S. Langford (Mr Murdoch), and was opposed by S. R. Havill (Mr Sellers).
