CANCELLED DEALER’S LICENSE. CHARGES DISMISSED. , : WELLINGTON,, September 19. Three charges under the 'Secondhand Dealers’ Act which had been preferred against Spiro Bardebes, a gold buyer, were dismissed by Mr E. Page, <S.-M. in a reserved judgment delivered in the Police' Court. B'ardebes applied to the Wellington City Council for ■ a 'license under the Second-hand Dealers’ Act, 1908, and this iwas issued to him on June 28 last, Subsequent to the issue of the license defendant learned of the result of a prosecution that had been instituted in another town wherein a charge of carrying on business as a second-hand dealer without a license was brought against a buyer of old gold, nnd was dismissed. Defendant, the magistrate said, believing from this dismissal that it was unnecessary for him to be the holder of a second-hand dealer’s license, and Snding that the existence of sugh ‘ license imposed on him certain, restrictions as to hours of trading, etc., decided to surrender the •,license. He •wrote to the City Council on July 2f returning the license and asking the council to cancel it. On August 2 he got a formal reply from the City Council stating that the license had been cancelled, and that the police authorities had been notified accordingly. After referring to the law on the question of cancellation of a second hand dealer’s license, th 6 magistrate said he thought defendant’s license had been validly cancelled and surrender'd, and that he was no longer a licensed dealer. As the charges against him were applicable only to a person who was the holder of a license the informations would have to be dismissed. “This decision,” the magistrate added “.leaves untouched the quest on .whether or not defendant is entitled t° carry on his business without -a license, i.e., whether he comes within the definition of a second-hand dealer. No charge has been laid against h'm in that regard,”
