A case of considerable interest to the racing community is before the Appeal Court today 'in the appeal of John Joseph Carry, of Blenheim, from Justice Herdman’s judgment delivered in Auckland last May, in tire action by Carry against John ahd James Paterson, of Auckland. The case concerns the ownership of thi© racehorse, Croupier, which was' seized by the Paterson brothers at Christchurch,after the last New Zealand Cup meeting. {

Corry brought an (action agauipt them in Auckland. Justice Herdman, giving judgment,, said that the Patersons were the owners of the horse, and that Corry was not, as ,an owner, entitled to any share of interest in the horse. However he found that Corry and the Patersons were partners in the runnings of the horse in the following, shares Corry fifty per cent., and the Patersons twenty-five per cent, each., He decreed the dissolution “of the partnership and that the accounts,,be taken of the partnerships dealing.

Corry is now .appealing against that dtecision. : Counsel for appellant moved for leave to read and adduce in evidence-,-, (1) Notice, of change of ownership., of half share in Croupier from Corry to. Paterson’s. (2) Form of Registration of their joint interests in the hor.se. These documents bad not been produced in .the--previous hearing-in the lower Court at Auckland, but since that hearing,' counsel stated; it dilad been discovered by the Secretary of the Racing Conference among:;. the. record's of the Conference. •*•?>'* t/> The Court accordingly granted the necessary leave.
