Justice Herdman . to-day (awarded. £75 each to Leighton Hill and Geoffrey .Goodwin, of Wellington,' who claimed damages from the Auckland Automobile Racing dub, and Henry James Butcher, its chairman. ’of directors, alleging that they were (assaulted by Butcher and his employees -on Ninety Mile Beach.
- They claimed £250 each as general damages, and £443 special After hearing counsel to-day, the judge said that there was no doubt that plaintiffs had been victims of unjustifiable assault, and the company would have to accept the responsibility for Butcher’s actions as he was acting in the company’s interests. Plaintiffs had not proved actual loss' to justify the award of special damages. The position regarding general damages was altogether different. No man had the Tight to tdke the law into his own hands.' In this'case"he thought it unnecsesary to award punitive damages, as plaintiffs had suffered no physicial, injury, and 1 their reputations fated (been vindicated.
