Janies Henry Smith, of Wellington, who carries on the business of a gold buyer in Wanganu and his .assistant, Peggy Stupider;, who manages thlel Wanganui shop, were charged with carrying on the business of a second hand dealer, not being the holder ofi, a: license. The case against Saunders was dismissed, as she was merely a servant, find thierVfore did not carry on. the business. Counsel for Smith laised the point that a second hand dealer was a man who not .only buys, but carries on the exchange of second hand artic Is. A man was not a second hand dealer who purchased .articles for th'a purpose of manufacture or sale: In the present case there was no evidence of tbj sale of any articles. The Magistrate upheld the point raised, and dismissed tile information.
