EXTRADITION ORDER
SET ASIDE BY JUDGE. (Australian Press Association.) MELBOURNE, July 21. A' unique point/' under the Fugitive Offenders’ Act, affecting’ a New Zealand>iizen, was decided Mr Just.ce J. K. Scott in chambers; to-day. Harry y Clinton McElwin, of Speedwell Oil, New Zealand, Limited had been arrested here on ; sf piovisionp.l 'warrant from New Zealaftd, charged with publishing a false prospectus. A City Magistrate had ordered hid return ,to .New Zealand. . / McElwin appealed, by way of a prohibition from the Magistrate’s order, it being argued that, -as/bivil proceedings were pending against him and his co-directors in New Zealand, proceedings for his return were not bona fide under Section 19 of the Fugitive Offenders’ Act. Mr Justice Street upheld the objection, and lie granted a prohibition, and ordered McElwin’s discharge, saving that the Statute was designed l io aid the apprehension of 'a criminal, and not for the collateral purpose of giving assistance to parties in civil proceedings.
