TRANSPORT ACT
bench RESERVES decision. (Per Press Association — Copyright.) NELSON, Judy 11. Decision ivas reserved in .test cases, the first of the 'kind in New .Zealand, against motor passenger service proprietors of continuing to run after the refusal of a .’.license to them, under the Transport Licensing Act. , The .argument centred on the wording 'Section.2o (b). The Magistrate -though it was dear that the word “aiid” following the first word of the sub-section “on,” was intended for “or,” and was accidentally, or carelessly inserted. Otherwise it nullified the statute, and led to an absurdity. Counsel submitted that in a penal statute, words could not be changed to bring inn offence under the statute, and in the present eases “and” couid not be read as “or.” The Magistrate said he would give the matter further consideration.
