Yesterday, when two employees of Bell Hill Sluicing Coy. were -endeavouring to clear the ‘‘jump-up”’at the head of the tunnel tail race, the blockage unexpectedly; came, away. One of. the men jumped clear, but the other was washed -down the ’ tail race for a distance of approximately 409 feet, into Deep Creek. It was feared by his fellow workers that he would suffer a sad fate, or at the least serious injuries, hut he miraculously came out of his experience with nothing more than a good ducking. A creek hatchery has ,- been established in the vicinity -of Ashburton golf links by the Ashburton Acclimatisation Society and comprises twenty boxes in seven sets, each box containing between 10,000 and 12,000 brown trout eggs in the process of hatching. The creek is. dammed at intervals so that the rate of flow of water varies between each set of boxes and daily temperature charts of, the. water, together with mortality tahl.es of the eggs, are kept. Most of the eggs have been obtained from trout caught in a special trap in the Ashburton river, and before liberation the trout are; tagged and sample, 3 of scales are taken for investigation by the Fresh Water Research Committee. On of the most highly esteemed citizens ,of Westport in- the person of Charles David Betts passed away atlas residence at’ 5 p.m. on Wedneday. Deceased has been confined to his bed foi- some considerable time, and his demise Was not- altogether unexpected. He was born in . Hokitika 65 years ago and later lived in; Reefton for a time and finally settled (down, in Westport, where, of late years, he helped his sons with the management of their motor garage. The late, Mr Betts was a man of a fine disposition, and he .was well and favourably known all over \the West Coast, where he followed mining pursuits for many yearn. In the Warden’s Court this morning an interesting point was decided by the Warden, Mr\W. Meldrumr. By a decision given in.;,the. Barry town oases at Greymouth, the . Warden held that a, mining privilege, marked out upon an existing Land Board title, required the preliminary steps contained in Section 98, 213 of the Mining Acy, 1926, n&ntely, that an application must . first he made to the Wardqfi for leave to peg, and the procedure followed a*> set out in that Section 1 prior to filing the application for the pound . The same conditions applied in respect to eight applications by Thomas Nolan and John A. Milne, at the Wataroa river in South Westland, but the applicants admitted through their \ counsel (Mr j. A. Murdoch), that the preliminary steps required by Section 93. 2B had not been taken. Counsel argued that, as the land owners had Imen made aware of the application, and objections had. been filed and subsequently withdrawn, this step taken by the landowners operated as a waiver, or estoppel, and he quoted authorities in support of his contention.- The evidence of Thomas Nolan, cine of the applicants was .taken, which proved that the preliminaries had been provided for thoroughly prospecting the -ground,, and the financial arrangements of the Company; he represented in the event of special claims being granted for paying full compensation to the land-owners for all land to bo taken. His Worship, giving judgment, said that he had already decided that applicants for ground included in registered licenses and renewable leases must be treated as applications for private lands, and, therefore, Section 93, 2B of the Mining Act applied. The ground was Crown Lands in the meaning of the Act, but his ruling in the Barrytown cases was a ruling on the question of procedure only, and he upheld the contention of' counisol (Mr Murdoch) in the present cases, that the doctrine of waiver applied, The applications were therefore granted.
